NEW INDEPENDENT CONTRACTOR GUIDANCE FOR PANDEMIC UNEMPLOYMENT ASSISTANCE
NEW GUIDANCE for independent contractors applying for Pandemic Unemployment Assistance was released by the New Jersey Department of Labor this afternoon.

Gov. Murphy signed legislation allowing a notary public to perform notarial services remotely during the COVID-19 public health emergency.
Under the new law, a notarial act can be performed remotely if the notary either has:
- personal knowledge of the member of the public’s identity
- a witness either by oath or affirmation that can identify the person seeking a notarial act and has at least two forms of identity.
Remote notarial acts can take place immediately and will continue during the COVID-19 state of emergency. A copy of the new law can be found at https://www.njleg.state.nj.us/2020/Bills/A4000/3903_R1.PDF.

Monmouth County Short Term Rentals
Short-term rentals (such as promulgated through services including AirBNB, VRBO and HomeAway), and other vacation rentals whether online, in-person, by Realtor or Owner transaction, which have been suspended since April 1, 2020, may resume starting June 25, 2020.
All hotel, motel and bed-and-breakfast reservations, which have been suspended since Friday, April 17, 2020, may resume starting Friday May 15, 2020 for guest occupancy beginning June 25, 2020. Guest occupancy from June 25, 2020 to July 2, 2020 may not exceed 25%; guest occupancy for July 3, 2020 to July 31, 2020 may not exceed 50%; and full occupancy may resume August 1, 2020.
These policies are per an Emergency Declaration signed by the City of Asbury Park OEM Director on 5/14/2020 and are subject to change in accordance with the circumstances of the COVID-19 pandemic.
TRANSIENT GUESTS OR SEASONAL TENANTS
The Borough will begin accepting Certificate of Occupancy applications effective immediately and plan on issuing Certificate of Occupancies effective on Tuesday, May 26, 2020.
Short Term Rentals: The restrictions placed on short term rentals from the 4.30.20 third amended proclamation are hereby rescinded. The short term rental restriction will remain in effect through the original date of 5.31.20 as listed in the second emergency proclamation dated 4.8.20.
Sea Bright - short term rental ban has been rescinded
Point Pleasant Beach Certificates of Occupancy will begin to be issued for new home purchases and new year-round rentals looking to establish long term residency only, as manpower and ability to conduct the required inspections allows. Penalties have been put in place for violations of the State of Emergency. No vacation rentals disguised as year-round will be tolerated. Short term vacation rentals will be assessed separately later in the month of May.
Spring Lake Heights- rentals permitted as of 5/22
Brick Township banned all short-term rentals in the township until further notice.
That the rental of homes and other residential units within the Borough of Seaside Heights via AirBNB, VRBO and other online marketplaces is hereby prohibited.until Governor Murphy lifts the State of Emergency for the State of New Jersey or until further action of the Seaside Heights Borough Council.
The Borough of Seaside Park has temporarily prohibited all transient and seasonal rental of hotels, motels, guest houses and residential homes or parts thereof within the Borough of Seaside Park, until the State of Emergency is lifted by the Governor.

Days On Market
We have had members ask if MORMLS can pause Days on Market. This is FBS’s position on it and we at MORMLS agree.
“The problem, however, is that pausing DOM distorts the accuracy of the data in the system. Years from now when the pandemic is hopefully a distant memory, we should be able to look back at the data and see the effect the pandemic had on days on market. If we see some markets where there’s no effect (because DOM was paused) and other markets where it wasn’t, that’s going to create a misleading picture. Another reason not to pause DOM is that no competitive advantage or disadvantage is created for any agent, the pandemic is impacting everyone the same. Lastly, the way DOM works in Flexmls, pausing DOM is way more complicated than one might think, so not messing with it really helps us out, too, and creates less of a chance for problems.”
